Holoneon Grid Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Holoneon Grid platform and services (collectively, the "Service"). By creating an account or using the Service, you ("User") agree to be bound by these Terms.

1. Eligibility and Account Registration

• Age: You must be at least 13 years old to use the Service. Additional minimum age requirements may apply depending on your local jurisdiction.
• Account Responsibility: You are responsible for all activities that occur under your account and for keeping your account credentials secure. You agree to notify Holoneon Grid immediately of any unauthorized use of your account.

2. User Content

• Your Responsibility: You are solely responsible for all text, images, data, or other materials you generate, upload, or post to the Service ("User Content").
• Ownership: You retain all ownership rights to your User Content.
• License to Holoneon Grid: By submitting User Content to the Service, you grant Holoneon Grid a worldwide, non-exclusive, royalty-free license to use, reproduce, display, and distribute your User Content solely for the purpose of operating, providing, and improving the Service. This license may include making your content available to designated third-party partners who assist us in operating the Service (e.g., cloud hosting providers).
• Content Warranty: You represent and warrant that you own or have all necessary rights, licenses, and permissions to submit your User Content and to grant the license described in these Terms, and that your User Content does not infringe on the rights of any third party.

3. Acceptable Use and Prohibited Conduct

You agree not to use the Service to:

• Post Illegal or Infringing Content: Distribute any material that is illegal, fraudulent, or infringes on any third party's intellectual property rights (e.g., copyright, trademark). The creation, distribution, sharing, or viewing of child sexual abuse material (CSAM) is absolutely and immediately prohibited. We have a zero-tolerance policy and will immediately report all instances to the appropriate authorities, regardless of the user's anonymity.
• Engage in Harassment or Hateful Conduct: Communicate or behave in a manner that is threatening, intimidating, "offensively coarse," or constitutes unwelcome sexual advances. This includes any actions or content that marginalize, belittle, or defame individuals or groups based on race, ethnicity, gender, religion, sexual orientation, disability, or other protected characteristics.
• Violate Privacy: Disclose the private communications of other users. You shall not use the service to reveal another person's personal identifying information without their express consent (an act commonly known as "doxxing").
• Disrupt the Service: Attempt to gain unauthorized access to other systems or networks, interfere with the Service's operation, or engage in any other criminal or harmful acts.
• General Misconduct: Engage in any other activity or communication that Holoneon Grid administrators or moderators deem unacceptable in their sole discretion.

4. Content Moderation and Termination

• Moderation: We reserve the right, but not the obligation, to monitor, screen, or remove any User Content at any time and for any reason, particularly if it violates these Terms. Content in public areas is subject to moderation.
• Termination: We may suspend or terminate your account and access to the Service at our sole discretion, without prior notice or liability, for any reason, including for any breach of these Terms. Violation of policies regarding illegal or infringing material may also result in possible legal action.

5. Privacy and Data Collection

Your privacy is important to us. Our collection and use of personal information, which may include IP addresses, government identification, and payment information, is governed by our Privacy Policy.

We treat all collected information as confidential and will only disclose it to third parties as necessary to comply with legal requirements, facilitate payment processing, or as otherwise described in our Privacy Policy.

6. Holoneon Grid Intellectual Property

All rights to the Holoneon Grid name, logo, brand identity, and the Service itself are the exclusive property of Holoneon Grid. Use of the Holoneon Grid brand in any way that implies an association or endorsement is prohibited without our prior written agreement.

7. Legal Terms

• Disclaimer of Warranties: THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. HOLONEON GRID MAKES NO GUARANTEE REGARDING THE AVAILABILITY, STABILITY, SECURITY, OR PERFORMANCE OF THE SERVICE, NOR OF ITS FITNESS FOR A SPECIFIC PURPOSE.
• Limitation of Liability: TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT SHALL HOLONEON GRID'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE TOTAL AMOUNT YOU PAID TO HOLONEON GRID, IF ANY, IN THE SIX (6) MONTHS PRECEDING THE CLAIM.
• Indemnification: You agree to indemnify, defend, and hold harmless Holoneon Grid from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising from your User Content, your use of the Service, or your violation of these Terms.
• Changes to Terms: We reserve the right to modify these Terms at any time. We will provide notice of significant changes (e.g., by posting on the Service or by email). Your continued use of the Service after such changes constitutes your acceptance of the new Terms.
• Governing Law: These Terms shall be governed by the laws of the State of California, USA, without regard to its conflict of law provisions.

Addendums for Tor Onion Service Access / Tor Region

1. General Principles and Jurisdiction

A. Anonymity and Identity

While we support the privacy afforded by the Tor network, all users connecting via the Onion Service must still adhere to the grid's one-account-per-user policy (if applicable) and maintain the integrity of their registered account identity as required by the Code of Conduct.

B. Jurisdiction and Reporting

All activities on the Tor region, as on all regions of this Grid, are governed by the laws of California, United States. Anonymity provided by the Tor network does not exempt users from complying with applicable laws. We will cooperate with law enforcement agencies in California, USA to the extent required by law.

2. Specific Rules for Moderation & Security

C. Enhanced Monitoring and Logging

Due to the unique security challenges of anonymous connections, the Grid reserves the right to employ enhanced, automatic, or manual monitoring and logging practices within the dedicated Tor region to detect security threats, abuse, and TOS violations. By connecting via the Onion Service, you consent to these measures, which may involve temporarily logging connection details to aid moderation.

D. Prohibition on Specific Activities

The use of the Tor region as a command-and-control server for botnets, distributed denial-of-service (DDoS) attacks, or any other activity designed to disrupt the Grid or external networks is strictly prohibited.

The creation, distribution, sharing, or viewing of child sexual abuse material (CSAM) is absolutely and immediately prohibited. We have a zero-tolerance policy and will immediately report all instances to the appropriate authorities, regardless of the user's anonymity.

E. Account Suspension and IP Bans

Violations of the TOS on the Tor region will result in the immediate and permanent suspension or deletion of the associated user account. While the Tor network provides anonymity, repeated or severe abuse from a specific network entry point may result in the temporary or permanent blocking of the associated Tor circuit or Onion Service.
